Problem: Unpaid debt for a loan given to a partner during their relationship, however after the relationship ended the ex-partner alleged that despite clear evidence to the contrary that the monies were a gift.
Outcome: Our lawyers were instructed and were able to agree settlement terms were our client recovered 90% of the loan.
How long did it take? Around 2 weeks.
Our expert debt recovery and insolvency lawyers successfully acted for a client in relation to an unpaid debt dispute. Our client during the course of his relationship with his ex-partner loaned money for various things. However when the relationship broke down the ex-partner alleged that the monies were a gift, and refused to return the money despite various admissions and promises to pay.
A statutory demand was served on the ex-partner demanding payment of the full amount loaned by our client. The ex-partner instructed a national law firm to oppose the statutory demand and an application to set aside the statutory demand was made. However, there were clear admissions and promises from the ex-partner to repay the loan monies which undermined the application.
Our experienced lawyers negotiated with the opponent’s solicitors and an outcome was agreed where the application and statutory demand were withdrawn, and the ex-partner would pay our client 90% of the monies given to the ex-partner during their relationship.
Our client was very pleased with the outcome as he had been battling with the ex-partner for over a year without progress, and several failed promises. Our client was particularly pleased as we were instructed on a fixed fee basis, and an outcome was achieved in less than 2 weeks of being instructed.
