The ex-partner instructed a national law firm to oppose the statutory demand and an application to set aside the statutory demand was made. However, there were clear admissions and promises from the ex-partner to repay the loan monies which undermined the application.
Our experienced lawyers negotiated with the opponent’s solicitors and an outcome was agreed where the application and statutory demand were withdrawn, and the ex-partner would pay our client 90% of the monies given to the ex-partner during their relationship.
