Our professional negligence lawyers successfully acted for a client in relation to a claim against their former solicitors for failings for a proposed lease extension and freehold purchase of flats.
Our client’s former solicitors served incorrect notices and followed the wrong procedures for seeking to extend the lease and was subsequently ordered to pay its own and opponent’s legal costs of these failed procedures. Several of the notices were not correctly completed or served by the negligent solicitors, and the procedures followed were wrong in any event.
The negligent solicitors had also (i) fraudulently attempted to backdate letters to cover up their negligence; and (ii) misrepresented written advice given by a barrister in relation to the matter.
The delays causing by the negligent solicitors meant that by the time our client sought to purchase the freehold of the flats it had to pay almost double the price of the flats than at the outset of the negligence solicitors (as the property had increased price considerably in the interim).
Our lawyers were able to recover 85% of our client’s pleaded claim and obtain the majority of our client’s legal costs from the insurer on the indemnity basis.
