Problem: Our client a property entrepreneur signed up for a property course for £15,000 which promised business mentorship from property experts. However, the course failed to provide mentorship and the programme providers kept trying to upsell other add-ons to seek to extract further monies from our client. Our client paid £7,500 upfront for the course, and raised a complaint which the course provider ignored.
Outcome: Our lawyers were able to prepare a detailed letter before claim, and engage with the course provider (and their solicitors) to settle the claim on the basis that £7,000 be returned to our client.
How long did it take? Around 4 weeks.
A property entrepreneur instructed our expert breach of contract lawyers in relation to a breach of contract claim in relation to a course provided by an online property academy business. The basis of the claim was 2 fold namely: 1. breach of contract – the course provider failed to deliver the mentorship of the programme, and the videos and content of the course were not fit for purpose and sub-standard 2. Misrepresentation – there were several misrepresentations made by the course provider as to the quality of the course and the value add but none of which were present in the course provided.
Our lawyers had a free consultation with the client and quickly assessed the situation, his options and the next steps. We were instructed to prepare a letter before claim to put the course provider on notice of the claim, and offered to resolve matters through ADR without Court proceedings.
Despite a carefully articulated letter before claim, and clear arguments and evidence as to why our client’s claim would succeed in Court, the course provider instructed legal representatives to seek to defend the claim and there was some correspondence exchange to seek to narrow the issues in dispute.
Ultimately, the course provider agreed to accept our client’s claim and a settlement was agreed for a refund of £7,000 to be paid by to our client. Our client was pleased with the result which we achieved within 4 weeks of being instructed by the client, and our client left our lawyers with the following testimonial:
After months of struggling with a rather shady company and getting nowhere, I was recommended to speak with Karim at Go Legal. He was incredibly reassuring, listened to my complaint attentively, and clearly presented my options. Within a few weeks of negotiations with the opposing lawyer, Karim was able to secure a fantastic settlement for me. I was over the moon! He is calm, reassuring, and responsive. I highly recommend Karim at Go Legal to anyone in need of a good lawyer.
