Our lawyers acted for a client in relation to a disputed invoice from a solicitors’ firm. The solicitors firm commenced debt recovery proceedings in the County Court for unpaid legal fees totalling over £20,000 before 1-month had passed from the date of the invoice.
We invited the solicitors’ firm to discontinue or stay the legal proceedings in order to allow our client to challenge the fees under the Solicitors Act 1974. However, the solicitors firm unreasonably refused and an application was subsequently issued at Court to have the stay claimed pending our client’s costs claim.
We successfully reduced the charged by over 40% and obtained a judgment that the solicitors firm be liable for our client’s legal costs on the indemnity basis (given that we had obtained an outcome that was more advantageous to our client than a carefully pitched Part 36 offer that had been made at an early stage in the proceedings).
Our client was able to recover significant reduction on the solicitors’ bill and was very happy with the work of our expert costs lawyers.
