Problem: Our client was successful in a £134,892.67 construction adjudication award however the sub-contractor sought to raise a meritless argument on jurisdiction and failed to comply with the adjudication award.

Our expert construction lawyers were instructed by a client who had contracted a builder to complete works on his property (roof extension, ground floor extension and other internal works). The works commenced in June 2021 but the contractor disputed the scope of the agreed work.

A dispute arose between the parties relating to the contractor’s wrongful suspension of the contract and/or its abandonment of the works under the contract, which amounted to a repudiatory breach of the contract and was accepted by the client, thereby terminating the Contract
Our client referred the matter to adjudication, and an adjudication award was given on 30 November 2023 in the sum of £134,892.67. However, the builder once again failed to comply with the order.
In the circumstances, our client instructed our firm to enforce the adjudication by way of a claim form (Part 8), and a hearing took place last week to determine the claim.
We successfully obtained judgment for our client enforcing the adjudicator for the sum of £134,892.67 plus interest and 100% of our client’s legal costs.
