Our professional negligence lawyers successfully acted for a client in a dispute against his former solicitors. The solicitors failed to extend the standstill agreement (extend time for the purposes of limitation by agreement) against the correct entity.
This meant that the claim against the correct party was time barred and if a claim was issued against that entity, then a strike out application would likely to have been issued (and successfully argued).
An interesting feature of this case was that the negligent solicitors knew that they had agreed the standstill agreement with the wrong entity however tried to cover it up, and at their own cost and behind our client’s back had instructed a barrister to advise on the issues. That advice was never shared or forwarded to our client. Instead, the negligent solicitors proceeded as if nothing was wrong and in fact, caused the claimant client to suffer further losses by advising him to issue a Court claim (and pay a £10,000 Court issue fee) against the wrong entity.
The claimant client also had insurance cover which meant that alongside recovering costs from the defendant in the underlying professional negligence claim, our client was also able to recover costs from its own insurer. This meant that overall, our client was able to recover 100% of its legal costs and did not have to pay for a successful professional negligence claim.
